Judge Gino #1: Will we have a club come Scum game?

Court is now in session. You all may have seen in the Forums that I asked you whether or not we will have a team going into the Scum FA Cup game. Well, thank you to those of you who took part in the debate, which I'll be honest was rather one sided.

Despite the doom-and-gloom of late there were distinct thoughts all round that in fact Pompey will have a club at the very moment the FA Cup game vs. Scum takes place.... however for how long after this game will remain to be seen....

It is well documented that Portsmouth FC has a court date approaching, and whilst I will not be presiding over that, it is looking likely that a winding-up order will be made. Pompeyrug esq. stated in his testimony that "even so, 'if' a ruling is made before the scum game - assuming 'liquidation' has not occurred by that point, and that is now a deadly serious possibility, we would most likely be given 30-day, or something like that, to settle the debt or be wound up?"

Squee followed this up with a link to the HMRC website regarding winding-up orders. This information seemed to suggest that once the order had been made, there will be additional time for the club to pay up. She then put forward further evidence, in the form of a link to the Chester City Chronicle, with the main point being that they were given 6 further weeks to pay up after being issued with the winding-up order. This precedent suggest the same will happen in Portsmouth FC's case.

Pompeycarpet almost welcomed the idea of the club going bust, by looking at it as a relief. Although in summing up, I think UKTony's words made it best: "Long answer: yes, but..."

JUDGMENT

A nice easy case to get us going, with most people in agreement that there will be a club for the Scum game.

The main debating point seems to be how long the club will last after that, and in fact it is looking ever-increasingly like the club will crumble into non-existence in a matter of weeks.
